Retainer and Payment. Client agrees to pay photographer a retainer of $25 at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. Balance is due at the time of the session.

 

Late Arrivals. Clients must arrive at their mini session at least 5 minutes before their scheduled session. Sessions CAN NOT be extended due to late arrival. Sessions will begin promptly at the allocated time. If clients arrive late to their session, the amount of time they are late will be deducted from their session time. 

 

Refunds. If Olivia Zemanek Photography, cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism, Covid-19 or other causes beyond the control of the parties, then Olivia Zemanek Photography shall return any moneys paid by the client, less non-refundable deposit, but shall have no further liability with respect to the agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without fault on the part of Olivia Zemanek Photography. 

 

Failure to Perform. In the unlikely event that the Photographer is injured or becomes too ill, or has an extreme emergency that prevents her from photographing the event, the Photographer will make every effort to reschedule the event. In the event that the Photographer does not show up to the event for no explained reason or without previously contacting the Client, a FULL refund will be provided to the client. 

 

Client Cooperation. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to specifying persons and/or scenes to be photographed; taking time to pose the photographs at the Photographer's direction; pre-shoot consultations; etc. The Photographer shall not be responsible for photographs not taken as a result of Client's failure to provide reasonable assistance, cooperation and communication.

 

Copyrights and Reproductions. The Photographer retains copyright to all images and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display on the Photographer’s website, social media or studio. and hereby grants the Client unlimited but non-exclusive rights to print, use or reproduce the photographs. Client may not sell the photographs in print or digital format for profit. Client must have written consent from the photographer if they would like permission to enter photos into any sort of competition including but not limited to online photo contests.

 

Archive. After three (3) months, all ordered images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control. The online gallery will be available to clients for 1 year. On December 10, 2024 photos may be removed from the online gallery link delivered to the client. 

Delivery. Photographer will have the best photos from the session edited and presented to the Client within 1 week, no later than 2 weeks after the session date. It is the sole decision of the Photographer which photos she chooses to professionally edit from the session and present to the Client. 

Print Quality. Photographer is not responsible for the print quality of photographs and products that are printed through external labs. The suggested lab from the photographer is Mpix Labs.

Model Release. I grant permission for Olivia Zemanek Photography, to take and use; printed or electronic publications, websites, or other electronic communications, media, advertising, promotion, marketing, and packaging for any products or service. I authorize the use of the images without compensation to me. All negatives, prints, digital reproductions shall be the property of Olivia Zemanek Photography. Model Release approval must be made by a parent/guardian if any photo session participants are less than 18 years of age. I agree that this release is irrevocable, worldwide and perpetual. I have read and fully understand this information in this model release. I agree this model release is for everyone involved in the session.
